1. Introduction & Acceptance

Welcome to MyDocki Digital Healthcare. These Terms & Conditions govern your access to and use of our website, mobile applications, and all services ("Services"). By registering, accessing, or using MyDocki, you confirm that you accept and agree to be bound by these Terms.

If you are using the Services on behalf of an organization (e.g. as a doctor, lab, or pharmacy), you represent and warrant that you have the authority to bind that organization to these Terms.

2. Definitions

  • User: any individual or entity (patient, provider, vendor) who uses MyDocki.
  • Provider: licensed healthcare professionals, labs, pharmacies, or vendors onboarded to deliver medical, lab, or pharmaceutical services.
  • Consultation: virtual or in-person engagement with a provider via MyDocki.
  • Platform: the MyDocki website, mobile apps, APIs, or services through which Services are offered.
  • Content: information, text, images, audio, documents, ratings, feedback or communications generated via the Platform.

3. Eligibility & Account Registration

  • You must be 18 years or older (or legal age) to register as a patient. Providers must hold valid, unexpired professional licenses.
  • You agree to provide accurate, current, and complete account information.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Medical Disclaimer & No Doctor-Patient Relationship

  • MyDocki is a technology platform connecting Users to Providers. We do not provide direct medical care.
  • Use of the platform does not create a doctor-patient relationship between MyDocki and you. The relationship is strictly between you and the Provider.
  • The content generated through consults (diagnoses, advice, prescriptions) is solely the responsibility of the Provider. You should seek in-person medical attention in emergencies.
  • MyDocki is not liable for any errors, omissions, or outcomes arising from services delivered by Providers.

5. User Responsibilities & Prohibited Conduct

You agree that you will not:

  • Use the Platform for illegal, harmful, or abusive activities.
  • Submit false or inaccurate information.
  • Upload viruses, malware, or malicious code.
  • Impersonate others or misrepresent affiliation.
  • Reverse-engineer or tamper with the application or underlying system.
  • Violate data protection laws, including unauthorized access or interception of data.

6. Consultations, Prescriptions & Service Limitations

  • All consultations are based on information you provide; Providers rely on that for advice or diagnosis.
  • Providers may refuse service or decline to prescribe certain medications.
  • Tele-consultation is limited in scope — for serious conditions, Providers may recommend in-person visits.
  • Digital prescriptions must comply with applicable laws in Nigeria (or user's jurisdiction).
  • Providers agree to maintain professional standards consistent with their licensing body.

7. Payments & Refunds

  • You authorize MyDocki (or its payment processor, e.g. Paystack) to charge applicable fees for Services.
  • Pricing, billing cycles, service fees, and taxes are clearly displayed before payment.
  • Refunds or cancellations are subject to MyDocki's Refund Policy. (See linked Refund Policy).
  • We reserve the right to amend fees; changes will be notified in advance.

8. Third-Party Services & Partner Obligations

  • Providers, labs, pharmacies, and vendor partners are independent contractors, not employees.
  • MyDocki does not control those third parties and is not liable for their actions or omissions.
  • Providers must be verified and submit licenses, CAC registration, and certifications as part of compliance.
  • MyDocki may remove any Provider for violation of these Terms or regulatory standards.

9. Intellectual Property Rights

  • All content, brand assets, designs, and software on MyDocki are the property of MyDocki or its licensors.
  • Users may not reproduce, distribute, or use any MyDocki intellectual property without prior written permission.
  • Providers grant MyDocki a non-exclusive, royalty-free license to use their content (images, profile, reviews) in promotions.

10. Limitation of Liability & Indemnification

  • To the fullest extent permitted by law, MyDocki's liability is limited to the amount paid by the user in the last 12 months.
  • MyDocki is not liable for indirect, incidental, special, or consequential damages.
  • You agree to indemnify, defend, and hold harmless MyDocki and its staff from third-party claims arising from your use of the Platform or violation of these Terms.

11. Data Protection & Confidentiality

  • All Users and Providers agree to handle personal and medical data lawfully and confidentially.
  • Providers will comply with NDPA, GDPR (if applicable), and implement best practices in data security.
  • MyDocki will maintain encryption, secure storage, and audit controls.

12. Termination and Suspension

  • MyDocki reserves the right to suspend or terminate accounts that violate these Terms.
  • Upon termination, users lose access to services, and their data may be anonymized or deleted per our Retention Policy.
  • Some provisions (e.g., indemnity, liability, intellectual property) survive termination.

13. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the Federal Republic of Nigeria.
  • Any disputes must be resolved exclusively in the courts of Lagos State, Nigeria.
  • Parties waive any right to litigate elsewhere.

14. Amendments to Terms

  • MyDocki may update these Terms at any time.
  • Material changes will be communicated via email, app notifications, or website banner.
  • Continued use after changes means acceptance of the updated Terms.
